Smoking Ban

Legislation

On 26th March 2006 a ban on smoking in public places in Scotland came into force. This followed a consultation process and the resultant drafting and then passing into law of the Smoking, Health and Social Care (Scotland) Act.

To help ensure that your business is able to meet the requirements of the new legislation, the Scottish Executive has sent out guidance to all businesses in Scotland. This is also available on the website www.clearingtheairscotland.com, which contains other information on the implications of the legislation, as well as case studies of businesses that have already adopted smokefree policies.

Signage

As from 26th March 2006 it was also an offence not to display a mandatory sign in all enclosed premises which include Bed and Breakfast establishments and guest houses etc, as well as certain motor vehicles.

The sign that is mandatory is of a prescribed type which includes a no smoking logo and wording which is exactly the same on every sign. There is a dotted line at the bottom of the sign which owner of premises must complete either by writing a name, a job title or a telephone number. Once this sign is in place at or near the entrance to the premises compliance with this law is complete.

The penalty for not displaying this sign is a fine of £200.
